1. Who we are

2. What we collect

• Account data. Name, email address, company, role, hashed password, and the marketing preference you set at signup.
• Verification data. Entity, lending jurisdiction, expected volume and the description you submit for review.
• Packet data. The documents you upload, the field values entered, the signers you address, and the resulting executed files.
• Evidence data. For each signer: timestamps, IP address, user agent and device family, the order of signing, and the moment consent to electronic records was captured. This is the certificate of execution and it is the point of the product.
• Support data. Messages sent through the contact form, with the IP address and user agent of the submission, used to answer you and to limit abuse.

3. What we do not collect

• We do not run advertising networks or third-party ad trackers.
• We do not sell or rent personal data to anyone.
• We do not read the content of your documents for any purpose other than delivering the service.
• We do not collect telephone numbers for text messaging. This is an email-only product.

4. Why we are allowed to use it

We process account, packet and evidence data to perform our contract with you. We process support data and security logs on the basis of our legitimate interest in operating and protecting the service. Marketing email is sent only on your consent, which you may withdraw at any time.

5. How long we keep it

Executed packets and their certificates are retained for ten years from sealing, or longer where a retention schedule or legal hold applies. Account data is kept while the account is open and for one year afterwards. Contact form submissions are kept for two years. Suppression records for unsubscribed addresses are kept indefinitely, because that is what keeps us from mailing you again.

6. Who we share it with

Infrastructure and email delivery providers acting as processors under contract, and nobody else, except where we are compelled by law or where disclosure is necessary to establish or defend a legal claim. Our primary operations are carried out from New York. A current list of sub-processors is available on request at help@borrowdocs.com.

7. Data breach notification

We maintain administrative, technical and physical safeguards designed to protect personal information. In the event of a breach of private information as defined by New York General Business Law § 899-aa (the SHIELD Act), we will notify affected New York residents and the appropriate state authorities in the most expedient time possible and without unreasonable delay, consistent with the needs of law enforcement and any measures necessary to determine the scope of the breach and restore the integrity of the system.

8. Your rights

Subject to applicable law, you may request access to your personal data, correction of inaccurate data, deletion, a portable copy, restriction of processing, or object to processing based on legitimate interests. Where the GDPR applies you may also lodge a complaint with your supervisory authority. Write to help@borrowdocs.com and we will respond within thirty days. We never charge for a rights request and never require you to waive anything to exercise one.

9. Cookies

We set only what is strictly necessary to keep you signed in. Details are in the Cookie Policy.

10. Children

The service is for business use and is not directed to anyone under 18. We do not knowingly collect data from children.

11. Changes

If we make a material change we will update the date on this page and, where the change affects how we use your data, tell you by email.
